The staff at Renova tips our collective hat to James “Jimbo” Matulis for passing his CDL road test. Jimbo passed with shining colors: he passed both his written and road tests on his first try, and now has the CDL-A with the air brake endorsement. That’s great news for our clients, as Renova can now be more places at the same time! Keep your eye out for Jimbo driving the big green dump druck and when you see him, tell him “Congrats!”

6/29/2011: “Game-Changer” Alert: UST Fund Has Insufficient Funds

Unfortunately, this news probably doesn’t come as a shock to many residents in the Garden State. It’s no secret that the government is working on developing strict measures to reign in the State budget, and programs like the UST Fund were vulnerable. While wishful thinking might certainly pay off, as the Fund could some day be restored to its former glory, it’s a more practical approach to use all of the cost recovery measures still available.

Renova is experienced in bringing stakeholders to the table to contribute to costly remediations. Our ability to seek out and find prior insurance carriers, even prior owners and their insurance carriers, can sometimes make or break a project’s viability. In addition to establishing the prior stakeholders, a forensic age dating investigation can determine the date of the initial discharge from the UST. A discharge of fuel oil is considered a “continuous trigger,” and the date of the release is used when determining the proportional cost allocation of responsible parties, including insurance coverage. Please feel free to contact our expert scientists for more information and a free consult.

3/13/2011: To Remediate or Investigate, THAT is the question.

One of Renova’s primary goals is to bring sites back into environmental compliance utilizing the least amount of resources required and to accomplish this without compromising safety or customer satisfaction.  One way we realize this goal is by performing consulting and contracting services in-house.

Another Renova maximizes value for our clients is by performing a comprehensive, remedial investigation before the remediation (clean-up) of contamination.  Proceeding in this manner poses inherent benefits to the client in terms of time and cost:

  • Cost Assurance:  The remediation proposal is based on the tonnage and location of the underlying contamination, which ensures an accurate remediation proposal.
  • Minimize Remediation Cost:  Soil and groundwater with impacts below the applicable remediation standards, which do not require remediation, would be left in place.  This yields a significant cost savings over using field screening techniques to determine “clean” from “dirty” material, and prevents over-excavation.
  • Avoid Project Delays:  The remediation would be initiated with the appropriate equipment and machinery to complete the job in one mobilization, avoiding costly down time.
  • Cost Recovery:  In certain cases, it’s possible to trigger pollution liability coverage under prior owners’ insurance policies.  An environmental claim is a “continuous trigger” and the coverage of prior carriers remains intact.  The outcome of insurance archaeology and subrogation of claims hinges on collecting accurate, thorough data in an investigation and keeping it intact for submission to the appropriate parties.
